The Family and Medical Leave Act (FMLA) is the federal law that protects the rights of eligible employees to be away from work up to 12 weeks per year because of their own or a family member’s serious health condition, becoming a mother or father, or military deployments.

The law also prohibits employers from unlawfully retaliating against employees for exercising their FMLA rights and requires that employers return employees to the same or similar position upon returning from leave.
